A | 한경협, 배임죄 적용 기업 영향 보고서 발표 배임죄 기소 공시 이후 기업의 현금보유비율 상승폭이 커졌다는 연구결과가 나왔다. 현행 배임죄 적용이 기업의 혁신과 투자활동을 위축시킬 수 있다는 우려를 실증분석 결과로 뒷받침한 것이다. 한국경제인협회는 26일 지인엽 동국대학교 경제학과 교수에게 의뢰한 '배임죄 적용이 기업의 위험회피 성향에 미치는 영향' 보고서를 통해 이 같이 밝혔다. 보고서가 2016~2026년 배임 기소 사실을 공시한 119개 상장사를 대상으로 분석한 결과, 배임 기소 공시가 발생한 분기부터 7분기 동안 기업의 현금보유비율은 통계적으로 유의미하게 상승한 것으로 나타났다.공시 분기의 현금보유비율은 직전 분기 대비 1.7%p 상승했으나, 이후 점진적으로 높아져 7분기 이후에는 5.4%p 상승한 것으로 추정됐다. 이 같은 상승폭은 분석 기간 중 분석 대상 기업의 평균 현금보유비율(12.0%)의 약 45%에 달하는 수치다.보고서는 배임 관련 사건의 효과가 단기에 그치지 않고 중장기적으로 지속됐을 가능성을 시사하며, 이러한 경향은 모형 설정과 관계없이 일관되게 나타날 수 있다고 봤다.특히 현금이 대표적인 저위험 자산이라는 점에서, 이러한 현금보유 확대가 기업의 위험회피 성향 강화에 따른 것으로 해석할 수 있다고 설명했다. 보고서는 "일반적으로 기업의 현금보유 정책은 조정비용주, 투자계획 및 자금운용 상의 제약 등으로 인해 단기간에 급변하기 어렵다"며 "그럼에도 배임 기소 이후 현금 비중이 중장기적으로 늘어난 것은 기업의 재무정책 기조 자체가 보수적·위험회피적으로 전환됐을 가능성을 보여준다"고 분석했다. 반면, 배임 기소 공시 이전에는 유의미한 현금 보유 증가세가 나타나지 않아, 기소 이후 관찰된 현금보유 증가가 기존 추세의 연장선이라기보다 사건 이후 발생한 변화일 가능성을 뒷받침했다.배임죄 관련 규제는 ‘임무 위배’ 등 구성요건과 적용기준이 모호하다는 지적을 받고 있다. 실제로 2015~2024년 배임·횡령죄의 1심 무죄율은 평균 6.2%로, 형법 전체 범죄 평균(3.0%)의 두 배를 웃돌았다.처벌 수위 역시 주요 선진국 대비 과도하다는 지적이다. 한국은 형법상 일반·업무상 배임죄 외에도 '특정경제범죄 가중처벌 등에 관한 법률'을 통해 이득액 50억원 이상일 경우 최대 무기징역까지 선고할 수 있도록 하는 등 주요국 중 유일하게 가중처벌 규정을 두고 있다.이상호 한경협 경제본부장은 "이번 연구는 배임 기소가 최종 유·무죄 판단과 무관하게 기업의 혁신과 투자활동을 위축시킬 소지가 있음을 실증적으로 확인한 것"이라며 "경영상 예측 가능성을 높이고 합리적 의사결정이 위축되지 않도록 배임죄 구성요건을 명확히 하고 경영판단원칙을 법률에 명문화하는 것이 시급하다"고 강조했다.。 Florida Gov.
